3. REFUNDS

3.1 How does it work

Our platform operates on a prepaid balance system.

Before subscribing to any service, the customer must add funds to their account. Once payment is confirmed, the amount is credited as digital credit available for use.

The balance:

  • Can only be used within the platform
  • Does not accrue interest
  • Is not transferable to third parties
  • Is not a bank account or a financial instrument

3.2 Balance Refunds

3.2.1 Consumer Customers

If the balance has not been used to subscribe to any service, the customer may request a refund.

Conditions:

  • There must be no active or initiated services associated with that balance
  • The account must not be under review for irregular activity
  • The request must be made within the minimum period required by the mandatory legislation applicable to the consumer's place of residence

When the law does not establish a specific period, the standard period will be 7 calendar days from the date of the top-up.

The refund will be issued via the same payment method originally used, except in cases of technical impossibility. Non-refundable processing fees charged by third parties may be deducted.

3.2.2 B2B Clients

For clients contracting as a business or professional:

  • Balance top-ups are final
  • Balance refunds are not applicable, except in the case of a technical error attributable exclusively to the platform or a duplicate charge

3.3 Balance and Services

When the client uses their balance to contract a service:

  • The corresponding amount is automatically deducted
  • The service begins immediately or automatically

Once the service has started:

  • The amount used is not refundable
  • Cancellation due to a change of mind is not permitted

This reflects the digital and immediate nature of the services offered.

3.4 Withdrawal

In jurisdictions that grant the right of withdrawal for distance contracts, the client may exercise this right only with respect to the unused balance. When using their balance to purchase a digital service that begins immediately, the customer:

  • Expressly requests the immediate commencement of service
  • Acknowledges that they forfeit their right to cancel the service once it has begun

This provision is aligned with international consumer protection standards, including those established by the European Union pursuant to Directive 2011/83/EU, as well as principles applied by authorities such as the Federal Trade Commission.

Nothing in this policy limits inalienable rights recognized by applicable mandatory legislation.

3.5 Anti-Fraud

To protect all users and ensure the security of transactions, the platform implements control and monitoring measures.

The company may:

  • Verify the account holder's identity
  • Request additional documentation
  • Temporarily suspend accounts under review
  • Hold the balance while a transaction is investigated

The following, among other things, will be considered irregular activity:

  • Use of payment methods without authorization
  • Attempts to chargeback after services have been consumed
  • Opening multiple accounts linked to the same payment method
  • Technical manipulation of the system

3.6 Chargebacks

If the customer initiates a chargeback with their financial institution after having used all or part of the balance:

  • The account may be suspended immediately
  • The remaining balance may be blocked
  • The company may claim the corresponding amount through available legal channels
  • Administrative fees arising from the dispute process may apply

Before initiating a chargeback, the customer must contact customer service to attempt to resolve the issue.

3.7 Liability

To the maximum extent permitted by applicable law:

  • The company's total liability is limited to the amount actually paid by the customer in the last three (3) months
  • The company will not be liable for indirect damages, loss of profits, loss of data, consequential damages, or loss of earnings
  • The company will not be liable for interruptions caused by third parties, user connection failures, force majeure, or external attacks

This limitation does not affect rights that the law considers inalienable.

3.8 Jurisdiction

Unless otherwise required by law:

  • The contract will be governed by the law of the country where the company owning the platform is incorporated
  • Disputes will be submitted to the competent courts of that country

In the case of consumers, this choice does not deprive the user of the protection afforded by mandatory laws of their habitual residence.

Where permitted by law, the company may opt for arbitration or alternative dispute resolution mechanisms.

3.9 Modifications

The company may update this policy to adapt it to regulatory changes or operational improvements. The current version will always be the one published on the platform.
